The Court of First Instance Nº 43 of Madrid has dictated a car, of date 1 of April of 2005, by means of which it rejects the pretension of the operator of telecommunications the past Combines so that it was come provisionally to execute a dictated by arbitration award, 1 of June of 2004, by the Commission of the Market of Telecomunicaciones (CMT) and resorted before the Provincial Hearing by Sogecable.
This award admitted the request of Combines to accede to the channels of sports of Canal+.
The CMT already rejected, the 1 of June of 2004, the pretension of Combines on their access to Canal+ and Canal+ Cinema, recognizing the exclusive feature of Sogecable on these channels.
The mentioned resolution recognized that Sogecable fulfilled the conditions imposed by the Government before integration of Via Digitalis when offering the Great Channel Via a those operators who wanted to contract a Premium channel.
