The district attorney adds that, with date of October 4, 2005, the Civil Guard realized an examination in the said business, where they took control of different decoders that were allowing to see all the channels offered by Digitalis +, as well as of a CPU that was provided with the necessary programs to realize these manipulations.

In the opinion of the district attorney, the facts are constitutive of a crime relative to the market and to the consumers, in such a way that it requests for each of the accused a year of prison and a fine of 12 months because of 7 daily euros.

For his part, the defender of the accused makes sure that in no case they have tried to make a profit economically but, 'in a most ingenuous and innocent way of the world', and coinciding with the beginning of the league of soccer, 'they wanted to have a detail with certain relatives, friends and some providers of confidence' whom they gave certain devices decoders of those that they distribute normally wholesale.

Yes he admits that the devices had been altered sufficiently so that they could visionarse across them the whole programming of the channel of television of payment of Digitalis + 'without having to pay a cent on this matter'.

In this sense he adds that only there were manipulated 10 or 15 devices decoders, which are those who were distributed.

For the defense, no crime exists and the acquittal of the accused proceeds.
